Welcome to PixelFunder. By accessing or using our platform, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account, accessing, or using PixelFunder, you agree to comply with and be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this platform.

2. User Accounts

2.1 Account Creation

To use certain features of PixelFunder, you must create an account. You agree to:

Provide accurate, current, and complete information
Maintain and update your information to keep it accurate and current
Maintain the security of your password
Accept all responsibility for activities under your account
Notify us immediately of any unauthorized use of your account

2.2 Account Requirements

You must be at least 18 years old to create an account and use PixelFunder. By creating an account, you represent that you meet this age requirement.

3. Prohibited Content and Conduct

PixelFunder has a zero-tolerance policy for inappropriate content. The following content is strictly prohibited:

3.1 Absolutely Prohibited Content

Nudity: No nudity of any kind is permitted on the platform
Pornography: No pornographic content, sexually explicit material, or sexual content of any nature
Sexually Explicit Content: No content depicting or describing sexual acts, sexual situations, or sexually suggestive material
Illegal Content: No content depicting, promoting, or facilitating illegal activities
Child Endangerment: Absolutely no content involving minors in any inappropriate context
Hate Speech: No content promoting hatred, violence, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
Violence and Gore: No graphic violence, gore, or content promoting harm to people or animals
Harassment and Bullying: No content targeting, threatening, or harassing individuals or groups

3.2 Fraudulent Conduct

Creating fake or misleading fundraising campaigns
Misrepresenting the purpose or beneficiary of funds
Operating scams or pyramid schemes
Impersonating others or organizations

3.3 Platform Abuse

Spamming, flooding, or creating duplicate content
Using automated systems or bots without permission
Attempting to circumvent security measures
Interfering with other users' ability to use the platform

4. Fundraising Grids

4.1 Grid Creation

When creating a fundraising grid, you represent and warrant that:

All information provided is truthful and accurate
You have the legal right to create the fundraiser
The fundraiser complies with all applicable laws
Funds will be used for the stated purpose
Your content does not infringe on any third-party rights

4.2 Platform Fees

PixelFunder charges a 5% platform fee on all transactions. Additionally, payment processing fees (Stripe) apply. All fees are clearly disclosed before purchase.

4.3 Fund Distribution

Funds are transferred directly to grid owners via Stripe Connect. PixelFunder is not responsible for how grid owners use the funds they receive.

5. Pixel Purchases

5.1 Transactions

When purchasing pixels:

All purchases are final (subject to our Refund Policy)
You receive the right to design and link your purchased pixel space
Pixels may not be resold or transferred
Your design and links are subject to moderation

5.2 Design Rights

By submitting a design or link, you grant PixelFunder a non-exclusive, worldwide, royalty-free license to display your content on the platform.

6. Content Moderation

PixelFunder reserves the right to:

Review, approve, or reject any grid before it goes live
Remove or hide any content that violates these Terms
Suspend or terminate accounts that violate these Terms
Refund purchases and remove content at our discretion
Report illegal content to appropriate authorities

We have zero tolerance for prohibited content. Violations will result in immediate content removal and may result in account termination and legal action.

7. Intellectual Property

7.1 Platform Content

All content on PixelFunder, including but not limited to text, graphics, logos, and software, is the property of PixelFunder or its licensors and is protected by copyright and other intellectual property laws.

7.2 User Content

You retain ownership of content you create, but you are solely responsible for ensuring you have the right to use any content you upload.

8. Disclaimers

PixelFunder is provided "as is" and "as available" without warranties of any kind. We do not guarantee:

The accuracy or reliability of any fundraising campaign
That funds will be used as represented
Uninterrupted or error-free service
That our platform is free from viruses or harmful components

9. Limitation of Liability

To the maximum extent permitted by law, PixelFunder shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the platform.

10. Indemnification

You agree to indemnify and hold PixelFunder harmless from any claims, damages, losses, or expenses arising from:

Your violation of these Terms
Your violation of any law or third-party rights
Your use of the platform
Content you submit to the platform

11. Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination:

Your right to use the platform ceases immediately
We may delete your account and content
Active fundraising grids may be removed
Refunds are handled per our Refund Policy

12. Changes to Terms

We may modify these Terms at any time. Continued use of the platform after changes constitutes acceptance of the modified Terms. We will provide notice of material changes.

13. Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law provisions.
